TERMS OF SERVICE

1. Introduction and Acceptance

Welcome to KDP NOW (the "App" or "Service"), operated by Ronna McKenzie, located in Hope, British Columbia, Canada ("we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of the App, which provides tools to format manuscripts for Amazon Kindle Direct Publishing (KDP) print-on-demand paperbacks and to convert manuscripts to EPUB format. By creating an account, uploading content, or using the App in any way, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally able to enter into contracts. By using the App, you represent that you meet these requirements and that you are authorized to upload and process the manuscripts you submit.

3. Description of the Service

KDP NOW is a productivity tool that helps authors and publishers:

• Format manuscripts (e.g., Word or other files) into print-ready files suitable for Amazon KDP paperback publishing.
• Convert manuscripts to EPUB format for digital publishing.

Important limitations:

• The App assists with preparing files according to Amazon KDP guidelines in effect at the time of processing.
• Amazon KDP requirements can change. You are solely responsible for verifying that final files meet current KDP requirements before uploading to your KDP account.
• We are not affiliated with, endorsed by, or sponsored by Amazon, Kindle Direct Publishing, or any related entity.

4. User Accounts

You may need to create an account to use the App. You agree to provide accurate information and keep it updated. You are responsible for the security of your account and all activity under it. Notify us immediately of any unauthorized access at feedbackgrandmamac@gmail.com. We may suspend or terminate accounts that violate these Terms.

5. User Content, Uploads, and Licenses

You retain all ownership rights in the manuscripts and other materials you upload ("User Content"). By uploading content, you grant us a limited license to process it solely to provide the service. This license ends when your outputs are delivered. You represent that you own or have rights to all content you upload. You own the formatted manuscript files and EPUB files generated by the App.

6. Intellectual Property

The App, including its software, formatting algorithms, conversion tools, and user interface, are owned by us. You retain ownership of your original manuscripts and final books.

7. Prohibited Uses

You agree not to upload infringing, illegal, defamatory, obscene, or fraudulent material, and not to violate Amazon KDP's terms of service, attempt to reverse engineer the App, or use it for any unlawful purpose.

8. Disclaimers

While the App is designed to help produce KDP-compliant files, we make no warranty that your formatted manuscript or EPUB will be accepted by KDP or result in a published book without issues. Outputs may require manual review and adjustments. We are not responsible for any costs, delays, rejections, or lost sales. The App does not provide legal, publishing, or marketing advice.

9. Privacy

10. Disclaimers of Warranties

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) CAD $100. We are not liable for indirect, incidental, or consequential damages including lost profits, data, or business opportunity.

12. Indemnification

You agree to indemnify and hold harmless Ronna McKenzie (operating as Grandma Mac) from any claims arising out of your use of the App, your User Content, or your violation of these Terms.

13. Payments

KDP NOW offers paid formatting and EPUB conversion services. Fees are non-refundable except as required by Canadian consumer protection laws. Payment processing is handled securely by Stripe. We do not store your credit card information.

14. Termination

We may suspend or terminate your account for violations of these Terms. You may terminate by contacting feedbackgrandmamac@gmail.com.

15. Modifications

We may update these Terms with notice. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and applicable federal laws of Canada. Disputes shall be resolved in the courts of British Columbia.
